Dual-use is a regulated innovation, not just a grant

Dual-use is not just a grant. It's a regulated innovation.
In view of the 15th meeting of the FENG Follow-up Committee, which was the subject of the presentation and vote on the criteria for the selection of defence and dual-use projects, it is worth looking at the dual-use not only through the financing prism.

The new FENG instruments — in particular 2.33 FENG for the manufacture of dual-use items and 5.1 FENG for critical technologies — can be an important impetus for the development of Polish technology, industrial and manufacturing companies.

But in the dual-use area, funding itself is only the beginning.

Product, technology, software, component, technical documentation or know-how may enter the export control regime, strategic trading, licensing, technology transfer restrictions or additional state security requirements.

Therefore, the company that plans to invest in this area should answer questions already at the project preparation stage:
• Is the product, technology or component classified as dual-use or military regime?
• is the model of sales, exports or technology transfer compatible with applicable regulations?
• Does the company have procedures for controlling customers, end-use and supply chain?
• have technical documentation, data, IP and critical knowledge been secured?
• have internal compliance, cybersecurity and risk management been implemented?

Therefore, the Association of Employers of the Green Business Responsibility Initiative (IZOB), acting in the business environment and in the ecosystem of the National Key Cluster Association of Innovative Technology in Manufacturing (Cinnomatech), consistently stresses among companies and its members that the effectiveness of the new support instruments will depend not only on the availability of funding, but also on the willingness of companies to secure, legally and scalable commercialisation of dual-use technology.

It's not enough to build a production line. We still need to be able to legally, safely and scalically commercialize what will be produced on it.

Therefore, dual-use financing should be designed together with implementation readiness, compliance, cybersecurity, intellectual property protection and regulatory risk analysis.

For many SMEs, technology itself will not be the biggest challenge, but the entry into an area where innovation becomes regulated, controlled and strategic.

This is a very important moment for Polish industry. But also the organizational maturity test of companies that want to enter the critical and dual-use technology sector.
